An Overview of Veteran's
Long Term Care Benefits
If you are a Wartime Veteran or spouse of a Wartime Veteran, you may be eligible for a variety of long term care benefits from the Veteran’s Administration, including a monthly payment to offset the costs of receiving care or the costs of assisted living, in-home care-giving services, and even grants to accommodate your home so you can continue to live in your home. In the workshop, Mark Albertson, Elder Law Attorney and Accredited VA Attorney, will review how the Veteran’s Health Care System Works, the VA Pension and Aid and Attendance benefit, and how to structure your assets so that you qualify for this benefit.
The 2011 Washington Trust Act.
Does it Affect You?
Amendments to the Washington Trust Act effective on January 1, 2012, apply both to those with testamentary Living Trusts and to those with trusts created under a Will. Two of the key changes deal with providing information to those interested in the trust. First, within 60 days of a trust becoming irrevocable (such as when a Trustor or Testator passes away), a trustee will be required to provide notice to all heirs, current beneficiaries, and future beneficiaries (for example, those who will inherit after a lifetime trust) of the existence of the trust, the Trustee's contact information, and other information. Second, the Trustee is required to provide a regular periodic accounting of all assets, expenses, income, etc., to the beneficiaries to keep the beneficiaries "reasonably informed". The new duties are added to the standard fiduciary duties of a successor Trustee or Personal Representative. If you named your children as a successor Trustee or a Personal Representative, or you are named, what has been agreed to?
